Terms of Service

Core Principles: Dấu Mốc is built for real riders. Ride safely, obey traffic laws, never use your phone while your vehicle is moving, and never fake GPS coordinates.

1. Acceptance of Terms

By downloading, accessing, or using the Dấu Mốc mobile application or website https://daumoc.com (operated by Lucas Tran), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please discontinue use of the Service.

2. Service Description

Dấu Mốc is a Rider's Passport application that enables users to discover landmarks and routes across Vietnam, verify visits via on-site GPS stamps or geotagged photos, record road journeys, and share verified travel milestones with the community.

3. Accounts & Eligibility

  • You must be at least 16 years old to create an account and use Dấu Mốc. If you ride a motorcycle or motor vehicle, you must hold a valid driver's license as required by law.
  • You are responsible for maintaining the security of your linked Google/Apple login credentials and for all activities that occur under your account.
  • You may not impersonate another person, use offensive usernames, or create multiple accounts to manipulate community ratings or statistics.

4. Stamp Integrity & Anti-Cheat Rules

The value of Dấu Mốc relies on authentic proof of presence. You agree NOT to:

  • Use mock-location apps, GPS emulators, root/jailbreak spoofing tools, or modified APK/IPA packages to fake your coordinates.
  • Edit or falsify EXIF metadata in photos submitted for Photo Verification.
  • Upload fabricated GPX files to claim stamps or routes you did not actually travel.

We reserve the right to automatically reject, revoke, or flag any stamp or journey that fails server-side integrity checks, and to suspend accounts that repeatedly attempt to falsify location data.

5. Road Safety & Navigation Disclaimer

Safety First: Never interact with your phone while riding. Always pull over to a safe, legal stopping point before viewing the map, taking photos, or dropping a stamp.

  • Not a turn-by-turn navigation system: Route maps, landmark coordinates, fuel reminders, and sunset estimates in Dấu Mốc are for reference and trip context only. Road conditions, weather, landslides, and gas station availability in mountainous areas can change without notice.
  • Rider Responsibility: You are solely responsible for your own safety, vehicle condition, fuel management, compliance with Vietnam's Road Traffic Law, and adherence to local border/forestry regulations (especially at border markers and restricted zones).

6. User Content & Community Guidelines

  • Ownership: You retain ownership of the photos, reviews, journey logs, and comments you post on Dấu Mốc.
  • License to Display: By posting content publicly on Dấu Mốc, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and format that content within the Service (and on shareable cards you generate).
  • Prohibited Content: You may not post content that is illegal, defamatory, sexually explicit, hateful, promotes dangerous/illegal street racing, violates third-party copyrights, or contains spam/unauthorized commercial solicitation.

7. Intellectual Property

The Dấu Mốc name, logo, seal graphics, Passport layout, curated landmark descriptions, route structures, and software code are the intellectual property of Dấu Mốc and are protected by applicable copyright and trademark laws. You may not scrape, copy, or redistribute our landmark/route database for commercial purposes without written permission.

8. Disclaimer of Warranties & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Dấu Mốc and its developer shall not be liable for any direct, indirect, or incidental damages, accidents, injuries, property loss, or data loss arising from your use of the app or participation in any road trip.

9. Suspension & Termination

You may stop using Dấu Mốc and delete your account at any time (see Account Deletion Request). We may suspend or terminate your access if you violate these Terms, particularly regarding GPS spoofing, community abuse, or illegal conduct.
